本利用規約（以下「本規約」）は、「RhythmForge」（以下「本アプリ」）の利用者（以下「ユーザー」）と運営者の間の契約条件を定めるものです。

1. はじめに

ユーザーは、本アプリのインストールまたはアカウント登録の開始をもって、本規約に同意したものとみなされます。同意いただけない場合は、本アプリの利用を中止してください。

2. アカウント登録と未成年者の利用

  • 本アプリの全機能（クラウド同期、マーケットプレイス等）を利用するにはアカウント登録が必要です。
  • 16歳未満のユーザーは、本アプリを利用するにあたり、法定代理人（保護者等）の同意を事前に得るものとします。

3. サービスの定義

本アプリは、メトロノーム、マクロ（練習フロー自動化）作成、練習記録のクラウド同期、マーケットプレイス（プリセット・マクロの共有）、およびコミュニティ機能を提供します。

4. ユーザーコンテンツの権利

  • ユーザーが作成したマクロ、投稿テキスト、機材写真等の著作権は作成したユーザーに帰属します。
  • ユーザーは運営者に対し、本アプリの運営、保守、改善、およびプロモーションに必要な範囲で、当該コンテンツを無償で非独占的に利用（複製、改変、翻案等）する権利を許諾するものとします。
  • マーケットプレイスに一般公開されたコンテンツは、他のユーザーが私的利用の範囲で自由にダウンロードし、利用できるものとします。

5. 禁止事項

ユーザーは、本アプリの利用にあたり、以下の行為を行ってはなりません。

  • 第三者の知的財産権（著作権、商標権等）を侵害する行為（市販のTAB譜の無断転載など）。
  • 他のユーザーに対するハラスメント、誹謗中傷、不快感を与える行為。
  • 本アプリの解析、逆コンパイル、リバースエンジニアリング、不正アクセス。
  • 本アプリの健全な動作を妨げる自動化スクリプトやボット等の使用。

6. 免責事項

  • メトロノームの動作精度およびタイミングの完全性を保証するものではありません。端末の負荷状況やOSのバックグラウンド処理により微小なズレが生じる可能性があります。
  • 端末の故障、サーバー不具合、または将来的なサービス終了に伴うデータの消失について、運営者は一切の責任を負いません。
  • ユーザー間でのコミュニティトラブルやマクロ共有に関する紛争について、運営者は関与せず、ユーザー同士で解決するものとします。

7. サービスの変更・終了

運営者は、事前の合理的な通知をもって本アプリの内容を変更、一時停止、または全面的に終了することができるものとします。

8. 準拠法および管轄裁判所

本規約は日本法に準拠し、本アプリに関する紛争は東京地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Service (hereinafter "Terms") define the conditions for using the "RhythmForge" (hereinafter "App") between the user (hereinafter "User") and the operator.

1. Introduction

By installing the App or starting the account registration process, you are deemed to have agreed to these Terms. If you do not agree, please discontinue using the App.

2. Account Registration and Use by Minors

  • Account registration is required to use all features of the App, including cloud synchronization and the preset marketplace.
  • Users under the age of 16 must obtain the explicit consent of a legal guardian (parent) to use the App.

3. Service Definition

The App provides a programmable metronome, macro creation, practice record synchronization, a marketplace (preset sharing), and community features.

4. Rights to User Content

  • Copyrights for macros, posts, gear photos, and other content created by the User belong to the User.
  • The User grants the operator a non-exclusive, royalty-free, worldwide right to use (reproduce, modify, adapt, publish, etc.) such content to the extent necessary for the operation, maintenance, improvement, and promotion of the App.
  • Content posted to the public Marketplace may be downloaded and used by other users within the scope of private use.

5. Prohibited Conduct

Users must not engage in any of the following activities when using the App:

  • Infringing on the intellectual property rights (copyrights, trademarks, etc.) of third parties, such as uploading copyrighted TAB sheets without permission.
  • Harassment, defamation, or any action that causes discomfort to other users in the community.
  • Analysis, reverse engineering, decompiling, or attempting unauthorized access to the App's servers.
  • Using automated scripts, bots, or tools that interfere with the App's normal operations.

6. Disclaimer

  • We do not guarantee the precision or timing integrity of the metronome's operation. Minor timing drifts may occur depending on hardware resource usage and OS background constraints.
  • The operator is not liable for data loss caused by device failure, server issues, or the partial/full termination of the App.
  • The operator takes no responsibility for disputes between users in the marketplace or community; such issues must be resolved entirely among the users involved.

7. Changes and Termination of Service

The operator may modify, suspend, or terminate the App or its services with reasonable prior notice.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any disputes regarding the App shall be subject to the exclusive jurisdiction of the Tokyo District Court in the first instance.
